1. About these Terms
Welcome to Marn Studios.
These Terms of Service (“Terms”) govern your use of marnstudios.com (the “Site”) and any purchases you make from Marn Studios through the Site.
Throughout these Terms, “Marn Studios”, “we”, “us” and “our” refer to the business operating Marn Studios. “You” and “your” refer to users of the Site and our customers.
Our online store is powered by Shopify, which provides the ecommerce platform that enables us to offer our products to you.
By using our Site or placing an order with us, you agree to these Terms together with our Privacy Policy, Shipping & Returns Policy and any other policies referred to on the Site.
Nothing in these Terms affects your statutory rights as a consumer.
2. Our products
Marn Studios sells art prints and related products as described on our Site.
We take reasonable care to ensure that product descriptions, images, dimensions, colours and other information displayed on our Site are accurate.
However, the appearance of colours may vary depending on your device, screen settings and lighting conditions. Images displayed on the Site, including lifestyle and room imagery, are intended to help illustrate how artwork may appear in an interior and may not represent exact scale in every setting.
Please refer to the stated product dimensions when selecting the appropriate size.
Unless expressly stated otherwise, artwork is supplied unframed. Any frames, furniture or decorative objects shown in lifestyle imagery are for illustrative purposes only and are not included.
We reserve the right to update product descriptions, availability and our product range from time to time.
3. Orders
When you place an order through our Site, you are making an offer to purchase the products in your order.
After placing your order, you will receive an acknowledgement or confirmation by email.
We reserve the right to decline or cancel an order where reasonably necessary, including where:
- a product is unavailable;
- there is an obvious pricing or product-description error;
- we are unable to authorise or process payment;
- we reasonably suspect fraud or unauthorised activity; or
- we are unable to deliver to the address provided.
If we cancel an order after payment has been taken, we will refund the relevant amount using the original payment method.
Please check your order details carefully before submitting your order, including the artwork, size and delivery address.
If you notice an error after placing an order, contact us as soon as possible at contact@marnstudios.com. We cannot guarantee that changes can be made once an order has entered production or fulfilment.
4. Prices and payment
Prices displayed on our Site are shown in the currency indicated at checkout.
Prices for UK customers include applicable taxes where required by law.
Any applicable delivery charges will be clearly shown before you complete your purchase.
For orders delivered outside the United Kingdom, additional import duties, taxes or customs charges may apply. Unless expressly stated otherwise at checkout, these charges are the responsibility of the recipient and are determined by the relevant local authorities.
We accept the payment methods displayed at checkout.
Payment must be successfully authorised before an order can be processed.
We may change our prices at any time, but changes will not affect orders that have already been accepted.
5. Delivery
We deliver to the locations specified on our Site.
Available delivery options, estimated delivery times and applicable charges will be shown on our Site or during checkout.
Delivery dates and times are estimates unless we expressly agree otherwise.
We will take reasonable steps to deliver your order within the estimated timeframe. However, delays may occasionally occur because of circumstances outside our reasonable control.
Unless otherwise agreed with you, we will deliver goods without undue delay and within the period required by applicable law.

Risk in the goods generally remains with us until the goods come into your physical possession, or the physical possession of a person you have identified to receive them on your behalf, except where applicable law provides otherwise.

6. Your right to cancel
If you are a consumer purchasing online in the UK, you generally have a legal right to change your mind and cancel an eligible purchase within 14 days after the day you receive the goods, without giving a reason.
Where an order contains multiple items delivered separately, the applicable cancellation period generally begins after you receive the last item.
To exercise your right to cancel, you must clearly inform us of your decision before the cancellation period expires.

Your statutory cancellation rights may not apply to certain categories of goods where an exemption under applicable law applies, including goods made to your specifications or clearly personalised.
This does not affect your rights where goods are faulty, damaged, not as described or otherwise do not conform to your statutory rights.

7. Returns following cancellation
If you exercise a statutory right to cancel an eligible order, you must generally return the goods within 14 days of informing us that you wish to cancel.
Unless the goods are faulty, damaged, incorrect, or we state otherwise in our Shipping & Returns Policy, you may be responsible for the direct cost of returning unwanted goods.
Please take reasonable care of products while they are in your possession.
You may inspect products as you reasonably would in a physical shop. We may be entitled under applicable law to reduce a refund to reflect any reduction in value caused by handling beyond what is reasonably necessary to establish the nature, characteristics and functioning of the goods.

Do not send returns to an address unless we have confirmed that it is the correct return address.
8. Refunds
Where you validly exercise your statutory right to cancel, we will provide any refund due in accordance with applicable law.
For eligible cancellations, this will generally include the price paid for the goods and the cost of our least expensive standard delivery option, where applicable.
If you selected a more expensive delivery method, such as express delivery, we are not required to refund the additional amount above our standard delivery charge.
Where you are required to return goods, we may withhold the refund until we have received the goods back or you provide evidence that you have returned them, whichever occurs first.
Refunds will normally be made using the same payment method used for the original purchase unless otherwise agreed.

9. Damaged, faulty or incorrect products
We want your order to arrive in good condition.
If your order arrives damaged, faulty or incorrect, please contact us as soon as reasonably possible at contact@marnstudios.com and provide:
- your order details;
- a description of the issue; and
- photographs of the product and packaging where reasonably possible.
We will assess the issue and provide an appropriate remedy in accordance with your legal rights.
Under UK consumer law, goods must meet applicable statutory requirements, including being of satisfactory quality, fit for purpose where relevant, and as described.
Nothing in these Terms limits or excludes your statutory rights.
10. Product availability and errors
We make reasonable efforts to ensure that information on our Site is accurate.
Occasionally, errors may occur in product descriptions, pricing, availability, promotions or other information.
If we discover an obvious error affecting your order, we may contact you to correct the error and, where appropriate, give you the option to proceed on the corrected basis or cancel the affected order.
If we cannot contact you or cannot fulfil the order, we may cancel it and refund any amounts paid for the affected products.
11. Intellectual property
Unless otherwise stated, the Site and its contents, including artwork, designs, branding, logos, photographs, graphics, text, product names and other materials, are owned by or licensed to Marn Studios and are protected by applicable intellectual property laws.
Purchasing an art print gives you ownership of the physical product you purchase. It does not transfer copyright or other intellectual property rights in the artwork to you.
Artwork purchased from Marn Studios is intended for personal use unless we expressly agree otherwise in writing.
You may not reproduce, copy, scan, digitally reproduce, commercially exploit, distribute, modify or create derivative products from our artwork or other protected content without appropriate prior written permission.
You may not use images or content from our Site for commercial purposes without our permission.
All rights not expressly granted are reserved.
12. Acceptable use of our Site
You must not use our Site:
- for any unlawful or fraudulent purpose;
- to infringe the rights of Marn Studios or any third party;
- to introduce viruses, malicious code or other harmful technology;
- to attempt to gain unauthorised access to our Site or systems;
- to scrape, reproduce or commercially exploit our Site or content without permission; or
- in any way that could damage, disable or impair the Site.
We may restrict access to our Site where we reasonably believe these Terms have been breached.
13. Third-party services and links
Our Site may contain links to or integrations with third-party websites, platforms and services.
These third parties operate independently from Marn Studios and may have their own terms and privacy policies.
We are not responsible for third-party websites or services that we do not control.
Our use of third-party providers does not affect any rights you may have against Marn Studios in relation to your purchase from us.
14. Shopify
Our online store is powered by Shopify.
Shopify provides the ecommerce technology that enables us to operate our online store.
Purchases made from Marn Studios are transactions between you and Marn Studios, not between you and Shopify.

16. Reviews and content you submit
If you submit a review, photograph, comment or other content to Marn Studios, you confirm that you have the right to provide that content and that it does not infringe the rights of another person.
Where you voluntarily submit content for publication or promotional use, you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce and display that content for purposes reasonably connected with operating and promoting Marn Studios.
We will not knowingly publish unlawful, defamatory, infringing or otherwise inappropriate content.

Nothing in these Terms excludes or limits liability where it would be unlawful to do so.
In particular, nothing excludes or limits liability for:
- death or personal injury caused by negligence;
- fraud or fraudulent misrepresentation; or

Nothing in these Terms affects your statutory rights as a consumer.
We are not responsible for losses that were not reasonably foreseeable when the contract was formed or for business losses arising from a consumer purchase, except where applicable law provides otherwise.
We are not responsible for delays or failures caused by events outside our reasonable control, but this does not affect any statutory rights you may have, including rights relating to delivery.

We will not be responsible for a delay or failure to perform our obligations where this is caused by circumstances outside our reasonable control.
Where such an event materially affects your order, we will take reasonable steps to minimise the impact and keep you informed where appropriate.

We may update these Terms from time to time to reflect changes to our business, Services or applicable laws.
The version that applies to your purchase will generally be the version in effect when your order is placed.

20. Governing law
These Terms and any contract between you and Marn Studios are governed by the laws of England and Wales, subject to any mandatory consumer protections that apply where you live.
If you are a consumer resident elsewhere in the United Kingdom, you may also benefit from mandatory protections and rights to bring proceedings in the courts applicable to your place of residence.
Nothing in these Terms limits any mandatory rights available to you under applicable consumer law.
